# Terms of Use

These Terms govern access to and use of GymPMS, the gym management software provided by Roberto Carlos Solis Garcia, Tax ID 48761636A. By creating an account or using the service you accept these Terms.

## 1. The service

GymPMS is a SaaS platform for managing gyms and studios: members, membership plans, manual assignments, simplified invoices and class bookings. Stripe payments and access control belong to tiers marked as coming soon while they are not available for purchase.

## 2. Account and acceptable use

- You are responsible for the accuracy of your account data and for keeping your credentials safe.
- You agree to use the service lawfully and not to compromise its security or availability.
- You are responsible for the lawfulness of the member data you enter into the platform.

## 3. Plans and pricing

- Basic plan: €99 per month per establishment.
- Pro plan: Stripe payments without turnstiles; coming soon and not currently available for purchase.
- Access plan: Stripe payments plus turnstile access control; coming soon and not currently available for purchase.
- Annual billing is available before purchase.
- Prices are shown excluding taxes; applicable taxes are added at billing.

## 4. Billing and cancellation

The subscription is billed periodically and in advance. There is no lock-in: you can cancel at any time and the service remains active until the end of the period already paid. Except where required by law, fees already paid are non-refundable.

## 5. Availability and support

We work to maintain high service availability, although interruptions may occur due to maintenance or external causes.

## 6. Intellectual property

The software, brand and content of GymPMS belong to the provider. The data you enter remains yours; you grant us a limited licence to process it solely to provide the service.

## 7. Data protection

Processing of personal data is governed by the Privacy Policy. When we process your members' data on your behalf, we act as a processor under Art. 28 GDPR.

## 8. Liability

To the extent permitted by law, the service is provided 'as is'. We are not liable for indirect damages or loss of profit. AI features generate suggestions that must be reviewed by qualified staff and do not constitute medical advice.

## 9. Governing law

These Terms are governed by Spanish law. Subject to mandatory consumer rules, any dispute is submitted to the courts of the provider's domicile.
